1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your purchase and use of products and services supplied by Solutions Purely Inc. (“Purely Solutions,” “we,” “us,” or “our”). By placing an order, completing checkout, or using a Purely Solutions product or Plan, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not place an order or use the product.
Your acceptance is recorded electronically at the time of your order, together with the version of these Terms then in effect. The version in effect when you place your order governs that order.
2. Definitions
In these Terms: “Product” means any water-filtration system, component, or replacement cartridge we supply; “System” means an assembled Product installed at your premises; “Plan” means the paid service and product offering provided in connection with your System, comprising only the elements listed in Section 3.1 and excluding those in Section 3.2; “Product Fee” means the one-time fee for the System and components supplied at the outset; “Service Fee” means any recurring fee for ongoing Plan services; “Installation” means the point at which your Installer has completed setup of the System at your premises, at which point responsibility for the condition and operation of the System passes to you; “Installer” means the licensed plumber or qualified professional who installs the System; “PDS” means the Performance Data Sheet published for a Product; and “you” or “Customer” means the person or entity placing an order.
3. Nature of What We Provide
3.1 What the Plan Includes
Purely Solutions provides a paid, continuing service Plan centred on your System. Subject to these Terms, the Plan includes only: the System and the replacement cartridges, filters, and parts made available through the Plan; software and applications we provide, including web or mobile applications, dashboards, and digital tools; notifications and reminders, including maintenance, replacement, and service reminders; updates, including software updates and updates to guides, documentation, and recommendations; filter and replacement management, including replacement scheduling and the supply of replacement cartridges and parts as offered; customer support and sales services; installation guides and documentation to be provided to your Installer; and recommendations and informational guidance regarding the use, care, and maintenance of your System.
3.2 What the Plan Does Not Include
For clarity, and notwithstanding any other provision, the Plan does not include, and Purely Solutions does not provide or assume responsibility for: installation of the System, which must be performed by a licensed Installer (Section 9); maintenance, servicing, adjustment, or repair physically performed at your premises; oversight, supervision, inspection, or monitoring of the System, your premises, your plumbing, or your Installer’s work; the physical condition, operation, or performance of the System once installed, except as expressly set out in the Limited Warranty (Section 23) and the Performance Guarantee (Section 18.3); any labour, removal, reinstallation, or on-site attendance; and any outcome dependent on factors outside our control. These matters are the responsibility of the System owner, to be carried out by the owner or by qualified third parties the owner engages.
3.3 The Nature of Our Relationship
The Plan is a service and product offering. It is not an assumption by Purely Solutions of responsibility for the installation, physical operation, or maintenance of the System. Once the System has been delivered, the return period in Section 8 has passed, and the System has been installed (Section 13), responsibility for the setup, operation, condition, and maintenance of the installed System rests with you. Our continuing obligations are limited to the elements of the Plan expressly set out in Section 3.1 and to the Limited Warranty and Performance Guarantee.
4. Your Local Consumer Rights
These Terms apply to all customers across Canada. Consumer protection is governed by the province or territory in which you reside, and the mandatory protections of your home jurisdiction apply to your purchase and prevail over any inconsistent provision in these Terms. This includes, as applicable and as amended from time to time: the Consumer Protection Act and the Civil Code of Québec (Quebec); the Consumer Protection Act, 2002 (Ontario); the Business Practices and Consumer Protection Act (British Columbia); the Consumer Protection Act (Alberta); and the equivalent consumer protection legislation of Manitoba, Saskatchewan, Nova Scotia, New Brunswick, Newfoundland and Labrador, Prince Edward Island, Yukon, the Northwest Territories, and Nunavut.
5. Plans, Fees, Renewal and Cancellation
5.1 Plan Structure
Your System is provided under a paid Plan. Depending on the Plan you select: a one-time Product Fee applies to the System, its cartridges, and parts supplied at the outset (a sale of goods); and, for certain Plans, a recurring monthly Service Fee applies to the ongoing service elements described in Section 3.1. Some Plans consist of a Product Fee only, with no recurring fee. The fees, billing frequency, term, and inclusions applicable to your Plan are those presented to you at the point of sale, which form part of these Terms.
5.2 The Product Fee Is a Sale of Goods
The Product Fee is consideration for the System and physical components supplied to you, which become your property upon payment. The Product Fee is non-refundable except as provided in Section 8 (Returns) or as required by law. The monthly Service Fee, where applicable, is consideration for ongoing services and is distinct from the Product Fee.
5.3 Term and Renewal
Plans with a recurring Service Fee run for the term presented at the point of sale and renew for successive periods unless cancelled. Before any renewal, we will provide advance notice in accordance with applicable law, including the cost of renewal and the means to decline it. You may decline renewal or cancel in accordance with Section 5.5 and your statutory rights.
5.4 Plan Benefits Are Conditional on an Active Plan
5.5 Cancellation
You may cancel your Plan at any time, subject to this Section and your statutory rights. The Product Fee is non-refundable once the System has shipped, except as provided in Section 8 or by law, as it represents goods already supplied to you. Where a recurring Service Fee applies, on cancellation you remain responsible for Service Fees accrued up to the effective date of cancellation, together with any early-cancellation amount permitted by applicable law in respect of services not yet rendered. We will not charge any amount in excess of what applicable law permits.
6. Orders, Pricing and Payment
All prices are in Canadian dollars and exclude applicable taxes, shipping, and duties unless expressly stated. We accept the payment methods displayed at checkout. Your order is an offer to purchase; a binding contract is formed only when we issue an order confirmation by email. We may decline or cancel any order before that point and may correct pricing or descriptive errors.
7. Shipping and Delivery
7.1 Delivery and Risk of Loss
We ship from within Canada. Delivery dates are estimates only and are not guaranteed. Risk of loss passes to you when the carrier takes possession of the shipment. Title to the System passes to you upon our receipt of payment in full.
7.2 Transit Damage
8. Returns, Refunds and Cancellations
As this is a distance contract, you benefit from the cancellation and return rights set out in the consumer protection legislation of your province or territory, which prevail over any inconsistent provision in these Terms. In addition to those statutory rights, and as a commercial courtesy:
- You may cancel an order at any time before it ships.
- Once shipped, you may return unused Products in their original packaging within thirty (30) days of delivery for a refund of the Product Fee. Return shipping is at your expense unless the Product is defective.
- Opened filter cartridges and consumables are non-returnable for hygiene reasons, except where required by law.
- Refunds are issued to the original payment method within ten to fourteen (10–14) business days after we receive and inspect the returned Product.
Part B — Installation and Ownership
9. Professional Installation
Our Systems are designed to be installed by a licensed plumber or qualified professional. Owing to provincial and municipal licensing requirements, Purely Solutions does not provide installation services and does not supervise or direct any Installer.
10. Product Safety and Regulatory Compliance
We are required by law to ensure our Products are safe and comply with applicable federal and provincial requirements, and we do so. Compliance at the point of installation, however, depends on your circumstances. Whether you own, buy, rent, or lease your premises, your building owner, property manager, condominium syndicate, municipality, zone, or region may impose rules, codes, or approval procedures before you install or modify plumbing. Your insurer may impose similar requirements. It is the purchaser’s and System owner’s responsibility to verify and comply with all applicable rules, regulations, and laws, and to complete any necessary due diligence, before purchase and before installation.
11. Customer Acknowledgements and Responsibilities
The purchase and ownership of a home water-filtration System involves shared responsibility. By acquiring a Product, you accept the responsibilities and inherent risks that come with owning, installing, and operating it, and you agree to exercise reasonable care throughout. Specifically, you acknowledge and agree that you have read and understood the installation instructions applicable to your System; that you are responsible for verifying that the System complies with applicable building codes, by-laws, regulations, and insurer requirements for your location; that the System will be installed, used, and maintained in accordance with our instructions; that you will operate the System within the limits specified in its manual; that you will act promptly and reasonably to limit any loss if a problem arises; and that you will retain records of installation, maintenance, and filter replacements.
12. Installer Acknowledgement Form
12.1 Signed Acknowledgement Required
As a condition of warranty coverage under Section 23, your Installer must complete and return the “Installer Acknowledgement and Confirmation Form” (provided with the System and available on our website) within fourteen (14) days of installation, confirming that the instructions were followed and the System was tested with no leaks present. If the form is not returned within that period, warranty coverage may be limited or suspended to the extent permitted by law.
12.2 Installation Records and Invoices
13. Responsibility After Installation
Our role is to supply the System and to provide the Plan services described in Section 3.1. Once the System has been installed by your Installer, it passes into your possession, care, and control. From that point, the condition, operation, setup, adjustment, and maintenance of the installed System are your responsibility.
Because the System is installed and handled by a third party and operated in an environment we do not control, we are not responsible for: the manner or quality of installation; any adjustment, modification, or repair by you or any third party; the interaction of the System with your plumbing, water pressure, service line, or premises; or any condition arising after installation. Our obligations after installation are limited to the Plan services and to the Limited Warranty in Section 23, which covers defects attributable to Purely Solutions only.
14. Keeping Your Information Current
We rely on your contact details to provide maintenance reminders, safety notices, advisories, and other important communications. It is your responsibility to keep your contact information current and to notify us of any change to your email, phone, or mailing address.
If you sell, transfer, or move out of the premises where the System is installed, it is your responsibility either to notify us so we can update our records, or to provide the new occupant or owner with this information, the product manual, and these Terms. We are not responsible for any consequence arising from our inability to reach you, or the current occupant, due to outdated or incomplete contact information.
Part C — Operating and Maintaining Your System
15. Filter Replacement and Maintenance
Timely filter replacement and routine maintenance are your responsibility. You must follow our filter replacement guides, recommended schedules, and maintenance instructions. We provide reminders and support as a courtesy but are not responsible for any issue arising from delayed, improper, or omitted maintenance.
15.1 Mandatory Filter Replacement (Two-Year Maximum)
Regardless of usage or apparent condition, all filters and cartridges must be replaced at least once every two (2) years. Filter media degrades over time even with light or no use, and replacement at this interval is required for safe and effective operation. Failure to replace filters within this period may compromise performance and safety and may limit or suspend warranty coverage.
15.2 Scheduled Component Replacement
These intervals apply regardless of apparent condition. Replacing these components on schedule is the owner’s responsibility. Failure to do so may compromise operation and may limit or suspend warranty coverage. Contact our support team in advance of these intervals to arrange replacement.
15.3 Routine Monitoring
Inspect your System at least twice per month. Confirm that no connection is dripping or leaking, that there are no signs of moisture, corrosion, or damage, and that pressure and flow appear normal. If you notice any leak, drip, unusual pressure, or sign of damage, stop using the System and contact our support team or a licensed plumber promptly.
16. Periods of Absence and Non-Use
16.1 Leaving the Premises
Before any extended absence, such as a vacation, we recommend shutting off the main water supply to your home entirely. When no one is present to notice a leak, a full main-supply shut-off is the single most effective way to prevent water damage, and it relieves pressure on the System. Operating any valve is the owner’s responsibility and should be done in accordance with the manual for your System or with the assistance of a licensed plumber.
16.2 Extended Periods of Non-Use
If a System will sit unused for an extended period — generally four (4) months or more with no flow — we advise contacting our support team and replacing the cartridges before resuming use. Depending on circumstances, replacement may not be necessary, but you should plan on the basis that it will be.
17. Water Conditions
17.1 Water Source Suitability
Our Systems are designed and built for treated municipal (“city”) water that is regulated as consumable and safe under Canadian federal and provincial standards. While certain Systems have proven effective on well water, the System’s safety parameters are engineered for municipal water conditions. Well-water quality varies significantly, and it is your responsibility to confirm that your water source is safe, suitably treated, and compatible before use.
17.2 Boil-Water Advisories
If a boil-water advisory is issued for your area, contact our office so we can help you understand how your System may be affected and whether the cartridges should be replaced. If replacement is required following an advisory, this is at the homeowner’s expense, as such events are outside our control.
Part D — Product Performance and Claims
18. FO Technology and Performance
18.1 What FO Technology Is
“FO Technology” (Fibre Optimization) is the activated carbon fibre (ACF) filtration platform used across our Systems. It is a configurable platform rather than a single fixed product: the media format, cartridge size, and flow configuration are adapted to suit different applications while using the same core filtration media. Accordingly, performance differs between products and configurations.
18.2 Basis of Performance Claims
All performance claims regarding our Products are based on data obtained under controlled laboratory conditions and do not represent real-world performance, which may vary due to factors outside our control. For the tested performance of a specific Product, refer to the FO variation number listed on that Product’s PDS. Test reports are provided for reference and may be updated.
18.3 Our Performance Guarantee
19. Certifications, Materials and Testing
Our primary filtration media (activated carbon fibre) is supplied by a partner that holds NSF/ANSI Standard 42 certification for aesthetic effects, such as the reduction of chlorine taste and odour. This certification applies to the media component only. Our complete Systems and cartridges have not been certified as assembled units under any NSF/ANSI system standard. Independent third-party laboratory testing has been conducted against recognized standards; summaries and reports are available on request and may be updated. We make no representation beyond the scope of the testing actually performed.
20. No Health Claims and No Medical Advice
Purely Solutions provides no medical advice and makes no representation, guarantee, or promise of any specific health outcome. Our Systems have been tested and shown effective at reducing certain contaminants, including health-related contaminants, under controlled laboratory conditions. Municipal (“city”) water is legally safe and consumable under Canadian federal standards, and our Systems are intended as a supplementary measure. Any reference to “optimal” or “ideal” water reflects our team’s and experts’ professional opinion, based on our own research and standards. It is a subjective professional view, not a statement of medical or scientific fact, and you are free to disagree with or challenge it.
21. Water Reports and Educational Data
Any water reports, data summaries, or related materials we provide are for educational and informational purposes only. They are intended to make water-quality data more visual and understandable; they are not medical advice and must not be relied upon as such. While we make reasonable efforts to validate the data, it may contain errors or omissions. Before acting on any report or making any decision based on it, you must review the original source document to confirm its accuracy. We reserve the right to update, correct, or withdraw any data or materials at any time without notice.
22. Software and Digital Services
Where the Plan includes software, applications, or digital tools, we grant you a limited, non-exclusive, non-transferable, revocable licence to use them for their intended purpose in connection with your System and Plan, while your Plan is active. The software and digital services are provided on an “as available” basis; we do not warrant that they will be uninterrupted or error-free, and we may modify, suspend, or discontinue any digital feature. We may collect and process personal information through these services in accordance with our Privacy Policy and applicable law.
Part E — Warranty and Risk Allocation
23. Limited Warranty
23.1 What Is Covered
We warrant that each System will be free from defects in materials and workmanship attributable to Purely Solutions for as long as the original purchaser owns and occupies the original installation address, subject to the replacement schedule in Section 15 (the “Warranty Period”). If a covered defect arises during the Warranty Period, our obligation under this warranty is the repair or replacement of the affected component at no charge.
23.2 What Is Not Covered
This warranty does not cover normal wear, consumable filters or cartridges, labour, removal, reinstallation, or any damage caused by improper installation, misuse, alteration, neglect, or failure to follow our instructions.
23.3 Conditions of Coverage
Coverage applies only where the System has been installed, used, and maintained strictly in accordance with our instructions; where the Installer Acknowledgement Form and installation records (Section 12) have been provided; and where scheduled filter and component replacements (Section 15) have been performed.
23.4 Your Statutory Rights
24. Recommended Loss-Prevention Measures
As a precaution, and consistent with guidance from many Canadian property insurers, we recommend — and for the P1+ (Whole-Home) System require, as a condition of warranty coverage — installing smart water-leak detectors and an automatic shut-off valve. These measures reduce the risk of water-related incidents and may qualify you for insurance premium discounts.

27. Notice and Opportunity to Cure
Before pursuing any claim under the Limited Warranty or Performance Guarantee, please provide us with written notice describing the issue and a reasonable opportunity to assess and, where appropriate, repair, replace, or otherwise address it. This step is intended to resolve concerns efficiently and does not limit or delay any right you have to seek recourse under applicable law, including before your provincial consumer protection authority or the courts.
Part F — General and Legal
28. Customers Outside Canada
Customers located outside Canada are solely responsible for verifying compliance with their local laws, plumbing and building codes, regulations, and insurance requirements, and acknowledge that Canadian consumer protections may not apply. By purchasing or using the System, you confirm you have done so and accept responsibility accordingly.
29. Intellectual Property
All trademarks, designs, text, software, and other content associated with our Products, Plans, and website are owned by Purely Solutions or its licensors. You receive a limited, non-exclusive licence to use the Products and Plan services as intended. No other rights are granted.
30. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada, subject always to the mandatory consumer protection laws of your province or territory of residence, which continue to apply and prevail. Disputes may be brought in the courts of the Province of Quebec, district of Montreal; nothing in this Section deprives you of any right to bring proceedings in, or to rely on the mandatory laws of, your home province or territory.
31. General Provisions
31.1 Force Majeure
We are not liable for any delay or failure caused by events beyond our reasonable control, including supply-chain, manufacturing, transport, customs, or supplier disruptions.
31.2 Severability
If any provision is held invalid or unenforceable, the remaining provisions continue in effect.
31.3 Entire Agreement
These Terms, together with your order confirmation and the Plan details presented at the point of sale, constitute the entire agreement between you and Purely Solutions.
31.4 No Professional Advice
Our guidance is general; installation must be performed and verified by a licensed professional.
31.5 Assignment
You may not assign these Terms without our consent; we may assign them in connection with a corporate reorganization or sale of assets.
31.6 Updates to These Terms
We may update these Terms from time to time. The version in effect at the time of your order governs that order. Material changes to ongoing Plan terms will be communicated with reasonable notice and will not apply retroactively to your original purchase.
